Litigation & Other Disputes

Scott & Scott represents financial institutions in disputes related to financial services and products, including creditor collections, business consumer lines of credit, bankruptcy, exit financing, lender liability claim defense, business torts, and fiduciary liability related to administration of corporate trusts and estates, testamentary and inter vivos trusts and pension plans. Scott & Scott represents clients in all phases of litigation and alternative dispute resolution, including arbitrations, negotiations, and mediations.

Transactions

Scott & Scott structures, negotiates, and documents loan transactions of all types. Our team has extensive experience with commercial loan transactions, service contract transactions, asset based lending, inventory and term loan financings, credit facilities (secured/unsecured), inter-creditor agreements, leasing transactions, letters of credit, senior and subordinated debt, and syndication agreements.

Representative Matters

  • Assisted financial services firms on GLBA compliance issues including drafting and implementing written information security policies, document retention policies, and privacy policies.
  • Advised mutual fund companies on software license compliance matters including disputes with publishers. 
  • Represented banks in software licensing matters including disputes with software publishers and the Business Software Alliance.  
  • Assisted mutual fund companies with investigation and management of network security incidents giving rise to a potential data breach.
  • Represented creditors in complex commercial litigation regarding non-performing loans and other high-stakes disputes.
